In
various cases involving construction firms that accidentally severed fiber-optic cables, analyses were provided to rebut the loss-of-use damages claims of the affected carriers.
In litigation brought under
the Telephone Consumer Protection Act of 1991 concerning a fax
broadcasting incident, a report was written on the difficulty that the
plaintiff was likely to encounter in attempting to notify the putative
class.
For an association of competitive pay telephone providers, a report was prepared that examined the network signaling and operational arrangements necessary to receive proper compensation for toll calls placed from public pay stations. This report was used as a foundation in a series of successful litigations.
In several unrelated litigations between former joint venture partners intending to offer telecommunications services, analyses were provided of the technologies to be supplied by one of the parties. These analyses refuted claims of minimum damages resulting from the terminations of the ventures. partner's lack of diligence in responding to regulator's concerns about the technology to be used and the services to be offered.
For a leading manufacturer of PBX equipment, analytic support and expert testimony were provided in connection
with a public utility commission inquiry into the Centrex pricing practices of a Bell operating company.
For the Alabama Department of Revenue, expert testimony was given on various historical and definitional issues that may affect the tax status of telecommunications service providers in the state.
Before the General Services Administration Board of Contract Appeals, expert testimony on matters of telecommunications network design was presented in several bid protest actions.
